This Privacy Policy (“Privacy Policy”) describes the information that SOFTCANE SOLUTIONS PVT. LTD. (hereinafter referred to as “Company,” “We,” “we,” “Our,” “our,” “Us,” or “us”), having its registered office at Plot No. 288, Sector No. 7, PCNTDA Industrial Area, Bhosari, Pune 411026, may collect from a user (“You,” “Your,” or “User”) on or through our website https://www.softcane.com/ (“Site”), directly or in relation to services otherwise rendered by Us (collectively “Platform”), and the use of our products and services provided through the Platforms (“Services”).

The Services may include installing and providing access to hardware or software devices for the implementation of the Platform, as may be provided by us through the Site, and scheduling a physical consultation with a Registered Medical Practitioner (each a “Service,” and collectively the “Services”). This Privacy Policy also explains how We use, process, disclose, and try to protect such information.

You agree and understand that the Company is responsible for the operation and maintenance of the Platform and that all information collected and processed on the Platform is collected and processed by Us strictly in relation to Our business. By using Our Platform, or the Services, you confirm that You have read, understood, and agree with the privacy practices described in this Privacy Policy, and the Terms of Use (the “Terms”) and the collection, storage and processing of Your information in accordance with them.
  1. This Privacy Policy complies with the Information Technology Act, 2000 (“IT Act”).
  2. It also adheres to the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”).
  3. Additionally, it follows the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Intermediary Rules”).

These Terms of Service (“TOS”) apply to the access and use of all of our applications (which are collectively referred to as “Platforms”) and use of our products and services provided through the Platforms (“Services”). The Platforms are owned, managed, and operated by SOFTCANE SOLUTIONS PVT. LTD. (hereinafter to be referred as “Company” or “We” or “we” or “Our” or “our” or “Us” or “us”) having its registered office at Plot no. 288, Sector no. 7, PCNTDA Indl. Area, Bhosari Pune 411026.
These TOS govern the use of the Platforms and Services by you, By accessing or using the Platforms, registering for Services offered on the Platforms, or by accepting, uploading, submitting, or downloading any information or content from or to the Platforms, you shall have agreed to these TOS.

Acceptance of Terms

Your use of the Platform is subject to these TOS, which may be updated, amended, modified, or revised by us from time to time, with or without notice to you.
IF CUSTOMERS DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, THEY SHOULD NOT PROCEED WITH THE IMPLEMENTATION OR USE OF THE SOFTWARE.

Use of Services

  1. The Platforms and Services are designed to assist users in storing, accessing, and reviewing information.
  2. While we strive to offer a functional and convenient service, we do not guarantee compatibility with all web browsers, uninterrupted service, or error-free content.
  3. We are not responsible for service interruptions due to technical issues, network failures, or other unforeseen circumstances.
  4. We reserve the right to modify, replace, or discontinue any part of the services or terms at any time, without prior notice.
  5. It is the user's responsibility to periodically check for changes to the services and terms. Continued use of the Platforms after any changes constitute acceptance of the new terms.
  6. The Platforms collect and store user information as per our Privacy Policy , which users are encouraged to review. By using the Platforms, users consent to the collection, storage, and use of their information in accordance with this policy.

Intellectual Property

  1. The Company retains full ownership of the Software and Documentation, including all intellectual property rights.
  2. The Customer is prohibited from modifying, reverse engineering, decompiling, disassembling, or creating derivative works based on the Software.
  3. We exclusively possess all proprietary information, processes, methodologies, software, web applications, and related intellectual property.
  4. The Customer acknowledges that all trademarks, trade names, copyrights, patents, and other intellectual property rights related to the Software belong solely to us.
  5. Any license granted to the Customer is non-exclusive, non-transferable, and limited to the terms specified in the agreement.
  6. The Software may include third-party components; the Customer agrees to adhere to any additional terms provided with these components.
  7. Upon termination of the agreement, the Customer must cease all use of the Software and Documentation and return or destroy all copies.
  8. The Customer must promptly notify the Company of any unauthorized use or infringement of the intellectual property rights associated with us.

Termination

The company reserves the right to suspend or terminate a user’s access to the related services with or without notice in the following cases:
  1. The user breaches any terms and conditions of the Agreement.
  2. A third party reports violation of any of its rights as a result of the user's use of the services.
  3. The Company is unable to verify or authenticate any information provided by the user.
  4. The company has reasonable grounds for suspecting any illegal, fraudulent, or abusive activity on the part of the user.
  5. If the user fails to fulfil payment obligations as per the agreed terms and conditions, the company reserves the right to suspend or terminate access to the software and related services until outstanding payments are settled.
  6. Company believes, in its sole discretion, that the user’s actions may cause legal liability for such user, other users, or for Company or are contrary to the interests of the software.
  7. On termination of an account due to the reasons mentioned herein, the user shall no longer have access to data, messages, files, and other material kept on the software by such user.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. This Agreement contains the entire agreement between the parties and may not be amended except in writing and executed by both parties

Support and Maintenance

  1. Support :
    We will provide technical support for the Software during regular business hours (Monday to Saturday, 9 AM to 6 PM).
  2. Maintenance :
    We will provide updates, patches, and bug fixes to the Software as they become available. The user agrees to promptly install such updates to ensure continued proper functioning of the Software.
  3. Exclusions :
    Support does not include issues caused by third-party products, unauthorized modifications, or misuse of the Software.

Warranty Disclaimer

The software is provided 'as is' by us without warranties, whether express or implied, including merchantability or fitness for a particular purpose. We strive for accuracy in data handling but holds no liability for its use or outcomes. Similarly, uninterrupted or error-free service is not guaranteed. Users acknowledge these conditions, understanding that company bears no responsibility for resulting claims, losses, or damages.

Severability

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law. It is the parties' intention that if any provision of this Agreement is deemed invalid or unenforceable, it shall not affect the validity or enforceability of the other provisions, and the Agreement shall be construed as if the invalid or unenforceable provision had never been included herein.

Indemnification

You agree to defend, indemnify, and hold company and any of its affiliates, employees, agents, directors, and representatives, from any legal claims, demands, and liabilities, including attorney’s fees, arising from or related to your use or misuse of the software or services, your breach of the terms, or your conduct. The company reserves the right to choose its own legal counsel and participate in its defence if it wishes. Additionally, we reserve the right to assume exclusive defence and control of any matter subject to indemnification, and you agree to assist and cooperate as required.

Assignment

The user may not assign this Agreement or any rights or obligations hereunder without the prior written consent of company. Any attempted assignment in violation of this provision shall be void and of no effect. Similarly, neither party may, without the other party’s prior written consent, assign, delegate, pledge, or otherwise transfer this Agreement or any of its rights or obligations under this Agreement to any party, whether voluntarily or by operation of law, including by way of sale of assets, merger, or consolidation.

Security

The user agrees to ensure that the Services provided by us are protected at all times from unauthorized access, use, misuse, damage, or destruction by unauthorized persons. In the event that credentials are accessed by any unauthorized person, the Company shall not be held responsible for any resulting consequences, including but not limited to the misuse of the Software or data theft, as detailed in the terms and conditions.

Force Majeure

Neither party shall be held liable for any delay or failure to fulfil its obligations under this Agreement due to circumstances beyond its reasonable control, such as acts of God, war, terrorism, natural disasters, labour disputes, or governmental regulations. You acknowledge that we are not responsible for any loss or damage resulting from delays or failures in services caused by Force Majeure Events, including but not limited to natural disasters, pandemics, or government actions. In the event of a Force Majeure Event, the affected party shall promptly notify the other party(s) of the situation.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings, agreements, or representations, whether written or oral, with respect to the subject matter hereof.
